The Indian constituent assembly during its sessions also recognized that tribal society cannot be governed by the common law of the country. In the year 1996, the Indian parliament passed a law called Panchayats (Extension to Scheduled Areas) Act, in which the core of this law is to recognize and promote tribal institutions to implement Panchayati raj in tribal areas.
But the ground situation is totally different, various state government ignored PESA and provisions of the 5th schedule of the Indian constitution. In this episode of Main Bhi Bharat we talk about the Padaha system of Oraon tribe and PESA.
