Kate Cox's pregnancy turned dangerous when her fetus was diagnosed with trisomy 18, which leads more than 95% of babies with the condition to not make it to birth. Cox's doctors also advised her that continuing the pregnancy posed serious risks to her health and fertility. Due to these risks they recommended she terminate the pregnancy. To go around Texas' strict abortion laws, she took her case to the courts, asking them to allow the procedure and making her the first woman to have asked a court to authorize an abortion since before Roe v.
